KAZAKH SUPREME COURT ORDERS FRESH HEARING
OF OIL TRADERS' CASE

Astana, 25 August: The Kazakh Supreme Court's supervisory
collegium has submitted the case of [seven] oil traders [the
limited liability partnerships Zhanarmay Torg, Petroleum Country,
Munay Sauda Oil, Karneftekhim, Vostok-munay Ltd, El-munay,
Kyzylorda Munay Service] linked with the Canadian PetroKazakhstan
oil company to the Astana city court for consideration, and
thus partially satisfied the protest of the Prosecutor-General's
office, an Interfax-Kazakhstan news agency has reported.
It was reported that [on 25 August 2004] the Supreme Court's
supervisory collegium had considered the protest of the Prosecutor-General's
Office against the ruling of the Supreme Court's collegium
for civil cases in the case of the seven wholesalers and retailers
of oil products accused by the antimonopoly agency [Kazakh
State Agency for Regulating Natural Monopolies and Protecting
Competition] of price collusion.
"Having considered this case, the Supreme Court's supervisory
collegium ruled: (...) [ellipses as published] To send the
case for fresh consideration and to partially satisfy the
protest, the court of first instance should one more time
investigate the negative consequences (of the price collusion)
and the amount of the (monopoly) income which is to be sequestrated,"
said the chairman of the Supreme Court's supervisory collegium,
Kayrat Mami, summing up the hearing.
